OK, please don't tell me what I *should have* done. I know that, now. About 18 months ago, I bought my first horse, a 2-1/2 yr old registered QH Paint. At the time of purchase, I was shown the registration, which was not in the seller's name (whom I rather considered a friend of mine, he worked at the barn where I rode and raised this guy from a yearling, started him, etc.). I was told by the seller/friend that all I had to do was fill in my name at the bottom and we would be all set - we even did that. The current owner listed on the paper is someone with whom he does business and it will be no problem to get her to sign the horse over. Well, fast forward a year and a half and I've contacted the APHA and procured a transfer form. Problem is, the original owner listed on the paper was not very friendly when I called to ask her to sign him over to me. Subsequent calls have found her unavailalbe. This friend, from whom I bought him, still says he is going to sort everything out, but I have my doubts. After that long introduction, my question is: what sort of options (gentle threats) do I have to move the transfer along? I'm not sure if there is a money issue (the owner listed on the papers mentioned something to the effect that she didn't sell him as a papered horse...), but if push comes to shove, I want to be ready. Hi, I'm not sure of the law since you don't say which country you live in. I think my approach at this point would be to contact a lawyer and have her/him write a letter to the person involved. If you buy a registered horse you are entitled to the papers, no matter what. At this point I'd want to see how far the person was willing to go on this point. Teresa |

Have you talked with the APHA about the situation? I have a friend that adopted an abused horse and was finally able to get his papers. There were certain steps that had to be taken but the Saddlebred Association was a great help. I'm sure that it varies somewhat by organization, but it won't hurt to ask. Sandi |

Me again. Still trying to get these papers but all I seem to be able to get is a runaround. As I read through these legal articles, I see references to Mediation and Mediation Services. Is there a company that *does* Equine Mediation? Meaning, I could hire these guys and they will contact the breeder, my "friend" who sold me the horse and the APHA and get everything sorted out? Just an update. The seller/friend actually DID come through for me. I am not longer at that barn but he gave the papers to a friend of mine. So, it took awhile but it all worked out in the end. If anyone out there starts to lose hope all I can say is, well, you never know. Another tidbit - I did contact the APHA. And, their member services representative told me that if I sent the following documents, they would contact the owner listed on the papers and help sort out the transfer. They needed: 1) The original registration papers (with the photo) 2) Bill of Sale from second owner (seller/friend) to me 3) My canceled check for payment I was also going to try to get them a copy of the bill of sale from the breeder to the seller/friend. There is a fee of I think $15/signature but to me it was a small price to pay. I hope that this information can some day help someone. But as always, hindsight is 20/20 - get those papers before you sign the check! Best of Luck to anyone in this situation.. |

Hi Sandi - I FedEx'd everything to Texas today. I'm a little worried that the writing we did on the original certificate might cause some additional heartache (i.e., they won't process the transfer). We put my new address at the bottom and there's a crossout where it says STALLION and now says GELDING. It's going to be 3-4 weeks for them to process and I am such a worry wart. Does anyone have any comfort that even with the writing I'll still be OK with the APHA? Or any experience that I won't be OK and what to be prepared for. Thanks, Joni |
