My race horse was taken from his stall at Turf Paradise, Phoenix, Az. The track found out who had taken him and requested that he be returned.
The horse appearently had a trailer accident while being returned and has been permently injured for racing purposes. I have contacted the person who took him and he does not want to discuss compenstion for my loss. Can I file criminal charges and how? How do you value a race horse with earning potential?

I am extremelty confused. If your horse was taken without your consent is that not theft? Also, who cares if the person who took him does not want to discuss it? Frankly he owes you for the value of the horse, if the situation is as you describe. I would be tempted to go the civil court route.

Dana - AAACK!! Also confused! Why, oh why, didn't you call the police and file a report/complaint asap? And I would have included the track in same. There must be more to this than meets the eye. At this point, while you can still certainly file criminal charges, any court is going to wonder the same thing. Also - what is the track's position on this? You must have some sort of contract with them re: security/liability for horses in their care? Maybe you can find a kind attorney who can give you some professional advice on how best to proceed without emptying your wallet.
