This is a plea for all of you out there who boards a horse or more in your "backyard" or who make payments when buying a horse. Get a caregivers lien. It will protect you in the event of nonpayment for the care and feeding of a horse and keep a person to whom you are making payments from coming and removing the horse from your property until all financial matters are settled. I had a horse who was supposed to be given back to the seller for a refund 6 months ago. I never heard from her. Thursday I started thinking, I've got a lot of time and money into a horse I gave back and started to inquire online about my legal options. I sent for a form for this lien after learning about it on a equine law site. Out of the blue, the very next day the seller picked her up from my house while I was at the store! Our agreement was she take the horse back and return my cash investment of $700. She left her here for 6 months! Now there is feed, shoeing, worming, etc. added on! If I had already had the lien in place, it would be a criminal case instead of a civil matter and I would have a better chance of settling this easily.

That is a great point! i hope everyone takes note. It is a good idea to keep a blank form handy even if you think you may never need it since unfortunatly the not so honest of the horse world can sometimes make some "hardened criminals" look like decent folk!
This should be posted in the tips area also.
Madi, Can you get this person who removed the horse for tresspassing at least? No-one should come onto your property without you permission unless they are there to read the gas meter!
Where is a bloody big visous(sp?) dog when you need it! :-)
I myself am dealing with a not so great horse person on a mare share agreement (i buy mare for half of service fee then after foal weaned she is all mine) I spent 8 months putting hundreds even possibly thousands of dollars into feed, suppliments and the best of care to ensure a Very healthy mare & feotus and she now has her for the next 5-6 months and i know i will get her back skinny as a rake but everything else is covered in a agreement i drew up and had her sign before she took her back to her place to foal.
This is not a legal document however and it's ability to cover me is limited (but she don't know that!:-0
Again, Fantastic idea Madi.
Julie
