Posted on Monday, Apr 11, 2005 - 3:24 pm: My friend's mare almost died from what I think is the breeders fault.My friend sent her maiden mare to this breeder. facts: maiden mare - This breeder did live cover on her 5 to 6 times total. I'll quote right from her emails: "I figured when I saw the little bit of blood the first time (the 17th) that it was maybe from her hymen not being completely broken the first few times she was bred. But wasn't quite sure, and then she seemed fine the next day and I checked her and saw no discharge or blood. Then when we bred her on the 19th and I saw the blood again, that's when I got worried and started asking questions and she went downhill from there and that's when I contacted you. March 18th email from breeder - "She is still in heat this pm so I will check her tommorrow afternoon early evening time and see what she is doing. She is really sore, being a virgin mare, so she is walking a little slowly and is being cautious about pooping...lol.. I've been watching her closely though and no signs of colic. I will talk to you tomorrow." I believe she was coved again on Marach 20th.. not sure, but the night of the 20th, Angel quit eating and was looking colicy. The breeder EMAILED my friend and told her that she needs to come get her mare and take her to a vet. My friend shows up at 8am the next day (Monday) morning to find her mare in pain with bloody stinky discharge. The mare's gut was all sucked up and distorted looking. She loads her up and a few blocks from the nearest vet, the mare goes down in the trailer. The vet put her on IV fluids and antibiotics and a pain epideral. (mare had 103 temp. & wasn't pooping); the race was on to save the mare. They felt she was starting to colic and told my friend that the mare was withing a few hours of dying. There was indeed a tear, bruising and an abscess blocking them from checking the uterus. The vet refered to this mare as her "little rape victim" because there was soooo much trauma. There was fear of the infection leaking into her gut - if the abscess would have burst, it would have been a death sentence. They couldn't keep her temp down so it was touch and go for about a week. Thousands of dollars later.... My friend finally gets to take her mare home. She tells the breeder she feels there was negligence on her part for waiting so long and would like her to pay for half of the vet bill. While in earlier emails the breeder did admit it was her first outside maiden mare and felt it was her fault, yet still refused to make any compensation. She infact told my friend that it was inhumane to have saved the mare, that it would have been cheaper to put her down and replace the mare!!! Anyone want to slap this breeder yet? Anyway... Then she had the tenacity to tell my friend that if she wants a foal still, that she will only breed to her Angel and will not substitute any other mare. Well, with all the scarring that could be there now, there's not guarantee that the mare will ever be able to carry and deliver a foal without bleeding out herself! Then she changed her mind and said she would allow my friend to substitute a mare, but my friend has to pay for the AI and find a different mare somehow. This isn't right!!! Any suggestions or comments? Can I get sued for slander by telling this story? This lady shouldn't be breeding and I don't want anyone else to have to go through this!! |

Posted on Monday, Apr 11, 2005 - 4:23 pm: You can't get sued for anything you haven't libeled/slandered anybody yet. we haven't a name or know any specifics. And there is no slander if its true. but this is a he said, she said scenario. And the person being libeled has to prove you wrong. So its a slippery slope.Truly sorry about the situation. But, what were the contract terms? anything in there regarding injury or trauma? if not, then i don't see how anyone is going to be able to go after anyone without. How is the mare now? Is she better? I am wondering what the vet said prior to breeding? and what exactly happened during the breeding? joj |

You would be better letting your friend handle this firsthand. I think anyone who has a colicky horse in their care and the only attention they give it is to email the owner is shamefully negligent in their responsibilities. DrO |
